Privacy Policy Statement We recognise the rights of our clients to have their personal and financial information protected. In the course of doing business with us, you may provide specific information to us so that we might better serve you. We treat this information as confidential and follow the Privacy Policy outlined below to ensure that this information is protected and used appropriately.
Protecting privacy is a responsibility that we take seriously. That is why we would like to explain to you that you can feel confident that we are committed to safeguarding your personal and financial information.
In this Privacy Policy statement, the term "personal information" has the meaning it has in the Commonwealth Privacy Act 1988 which provides:
"personal information means information or an opinion (including information or an opinion forming part of a database) whether true or not, and whether recorded in material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion."
Our Policy We do not collect personal information unless it is reasonably necessary to enable us to provide to you the service, or to process transactions, which you or your authorised agent have requested, or to enable us to provide you with financial information or investment opportunities which we reasonably believe that you would wish to receive.
The information we collect and its sources We collect a variety of personal information depending upon the service we provide to you. This may consist of contact information (such as address, telephone number), personal financial information (such as your investment decisions and goals, your investment portfolio, bank account balances), shareholder identification information (SRN and HIN numbers), taxation information (such as your tax file number). Where we provide financial advice, we may collect additional personal information (such as your age, occupation and employment, health, dependants), and additional financial information (such as individual or family income, expenditure, assets, liabilities, insurance, social security entitlements). We may, before accepting you as a client, obtain personal information from the Stockbrokers' Mutual Reference Society.
We collect this information from your personal meetings with us, forms which you may complete at our request, communications with us via phone, fax, e-mail or mail, or transactions with us or which we execute on your behalf. If we collect personal information from a third party such as another party to a joint account, we will advise you that we have received that information and ask you to acknowledge receipt of our advice to you.
Disclosure of information Except as provided below or to the extent necessary to carry out your instructions we will not disclose personal information to third parties. In order to carry out your instructions we may disclose relevant personal information to shareholder registries and/or organisations in which you have requested us to make an investment on your behalf. If you have disclosed your tax file number to us, we may be required by law to disclose it to any organisation in which you make an investment.
Disclosure to affiliates We may share personal information with F. H. Nominees Pty Ltd, a wholly owned subsidiary of F. W. Holst & Co. Pty Ltd.
Disclosure to third parties not affiliated with us We may share the personal information we collect, as described earlier in this statement, on a limited basis with certain non-affiliated third parties.
We may disclose personal information to third parties where we believe it is reasonably necessary for the conduct of our business. For example, we may disclose personal information to service providers to enable them to provide business services for us such as performing computer or data maintenance, to our auditors, our attorneys, and our insurance underwriters.
If, after having taken reasonable steps to obtain money owing by you to us for services provided, the money remains unpaid, we may notify the Stockbrokers' Mutual Reference Society of relevant personal information and details of money owing to us. We may disclose personal information to third parties where disclosure is required or authorised by law. We may disclose limited personal information to a mailing house with which we have contracted to mail newsletters or other investment related information to clients generally or to selected clients.
We will not sell, disclose or share your personal information to non-affiliated third parties who may want to sell their products or services to you. We do not disclose client lists and we will not disclose your name to a catalogue company, telemarketer or like organisation.
Opting out of mail and e-mail If you do not wish to be included on any mail out list for investment or financial material such as newsletters, or to receive such material via e-mail, please write to us at the above address or email us at privacy@holst.com.au.
Please note that where your account with us is a joint account, we will act, in this regard, on instructions provided by any one of the joint account holders. Notwithstanding that you may have indicated that you do not wish to be on any mailing list, on occasions we may be required by law to provide you with certain material by mail if we have not already handed it to you personally.
Access to your personal information and keeping it up to date We aim to ensure that the personal information that we hold is accurate. To assist us with this, please contact us if any of the information that you have provided to us changes. You are able to access the personal information we hold about you during our usual business hours.
What are the consequences of your not providing personal information requested? Depending on the nature of personal information withheld, we may be unable to carry out your investment instructions or may be unable to provide you with investment or financial advice which is appropriate to your circumstances.
Internet communications Communications over the Internet (including e-mail) are not necessarily secure and may be intercepted by third parties.
Former clients Even if you are no longer a client of F.W. Holst & Co. Pty Ltd, our privacy policy will continue to apply to you.
